1. Definitions and General Provisions

1.1 Definitions

• "Service" - AI Developer Toolkit educational platform and all related services
• "Provider" - Wondel.ai sp. z o.o., a company registered in Poland
• "User" - any person accessing or using the Service
• "Subscriber" - a User with an active paid subscription bought before we stopped selling subscriptions on 14 October 2026
• "Holder" - a User with active access from a purchase of the Toolkit or the Team Toolkit, or named by the buyer of a Team Toolkit
• "Content" - educational materials, documentation, guides, and other resources
• "Agreement" - these Terms of Service

2. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you must not use our Service.

3. Service Description and Scope

3.1 Currently Available Services

• Access to educational content about AI-powered development tools
• Learning tracks and tutorials for Cursor and Claude Code
• Downloadable resources and cheat sheets
• Access to private Discord community
• GitHub repository access for documentation contributions
• Team management features (Team Toolkit)
• Sign-in with Google or GitHub

3.2 Services Coming Soon

The following features are planned but not yet available:

• Team analytics and ROI dashboards
• Shared context rules and templates
• Token usage tracking
• Custom onboarding programs
• Enterprise SSO/SCIM
• Audit logging

4. User Accounts and Purchases

4.1 Account Creation

• You must provide accurate and complete information
• You are responsible for maintaining account security
• You must be at least 16 years old to create an account
• One person or entity may not create multiple accounts for circumventing restrictions

4.2 What We Sell

We sell the following one-time purchases. None of them is a subscription, and none renews automatically.

• Toolkit: a one-time payment for 12 months of access, for one person, to all Content, the ebooks (as EPUB and PDF downloads), the full Setup Pack generator, and the updates we publish during those 12 months
• Team Toolkit: a one-time payment for 12 months of the same access for up to 10 people: the buyer, and up to 9 more people whom the buyer names by email address on the account page. The buyer may remove a person and add another during the access period, and is responsible for the named people's use of the Service under these Terms
• Toolkit renewal and Team Toolkit renewal: a one-time payment that extends access by 12 months. A Toolkit renewal is available to anyone who has bought the Toolkit; a Team Toolkit renewal to the buyer of a Team Toolkit. The 12 months are added to the current end date of the access or, if the access has already ended, run from the date of the renewal
• Free access: without a purchase, you may read a limited number of articles each month and the sections we mark as free. We may change the free allowance at any time

4.3 Access Period

• Access starts when the payment is confirmed and ends at the end of the access period shown on your account page
• Nothing renews automatically. We do not charge you again unless you buy a renewal
• When access ends, files you downloaded during the access period (ebooks and generated Setup Pack files) remain yours to keep under the license in section 6.2. Downloading again, generating new Setup Pack files and reading beyond the free allowance require active access

4.4 Prices, Payment and Taxes

• Payments for the Toolkit, the Team Toolkit and renewals are processed by Polar (polar.sh), which acts as merchant of record and issues the invoice
• Prices on English-language pages are in US dollars (USD). Prices on Polish-language pages are in Polish złoty (PLN) and include VAT. The price that applies is the one shown at checkout
• On English-language pages, VAT or sales tax is calculated by Polar according to your location and shown at checkout
• Services for teams (section 4.8) are priced net of VAT and invoiced separately by Wondel.ai sp. z o.o.

4.5 30-Day Money-Back Guarantee

Within 30 days of your first purchase of the Toolkit or the Team Toolkit, you may request a full refund, for any reason, by emailing support@developertoolkit.ai. The guarantee applies once per customer, to a first purchase only, and does not cover renewals (4.6 says what applies to a renewal). A refund ends the access bought with that payment, including the access of the people named on a Team Toolkit. This guarantee is in addition to your statutory rights.

4.6 Right of Withdrawal for Consumers

If you are a consumer, you have a statutory right to withdraw from a distance contract within 14 days of concluding it. Access to the Toolkit and the Team Toolkit starts as soon as the payment is confirmed, and we do not ask you to give up that right to get it. Within 14 days of buying, email support@developertoolkit.ai and we refund the payment in full.

For a first purchase, the 30-day guarantee in 4.5 gives you longer, for any reason. A renewal is not covered by the 30-day guarantee, but the statutory right is: a consumer may withdraw from a renewal within 14 days of buying it and is refunded in full.

4.7 Subscriptions Bought Before the Switch

We stopped selling subscriptions on 14 October 2026 and no longer sell new ones. A subscription bought before then continues on the terms below, which are the terms in force when it was bought, and keeps renewing at its price until you cancel it from your account page or the Polar customer portal. Access granted before then without an end date continues.

• Individual subscription: single user access to all educational content
• Team subscription: one subscription for a team. The subscriber adds up to 5 company email domains, or up to 20 named email addresses, on the account page, and everyone who signs in with an address on a listed domain, or with a listed named address, has access under the subscription, with team management features
• Enterprise subscription: unlimited seats from multiple domains with priority support and custom features
• Payments are processed through Polar (polar.sh) in USD and are subject to taxes
• Subscriptions auto-renew unless cancelled
• Monthly plans are paid in advance
• No refunds for partial periods, except as required by law
• New subscribers have 30 days from initial purchase to request a full refund if unsatisfied with the Service. This guarantee applies only to first-time purchases and cannot be used repeatedly
• You may cancel at any time. Cancellation takes effect at the end of the current billing period, with no refund for unused time, except as required by law

4.8 Services for Teams

Services for teams are sold separately by Wondel.ai sp. z o.o. under a written proposal that sets out the scope, the price and the payment terms. These Terms apply to a service only where the proposal says so.

5. Acceptable Use Policy

5.1 Permitted Use

• Personal learning and skill development
• Team training and education (with a Team Toolkit)
• Contributing improvements to open-source documentation
• Sharing knowledge within the community

5.2 Prohibited Use

You may not:

• Share account credentials, or your access with anyone not named on your purchase
• Resell, redistribute, or republish Content without permission
• Use automated tools to scrape or download Content in bulk
• Reverse engineer or attempt to extract source code
• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Harass, abuse, or harm other users
• Impersonate others or provide false information

6. Intellectual Property Rights

6.1 Our Content

All Content provided through the Service is owned by Wondel.ai sp. z o.o. or used under license. This includes but is not limited to text, graphics, logos, images, audio, video, and software.

6.2 License to Use

Buyers receive a limited, non-exclusive, non-transferable license to access and use Content for personal or internal team educational purposes during the access period they paid for. Files downloaded during that period may be kept and used under the same license after it ends.

6.3 User Contributions

By submitting contributions (e.g., pull requests, community posts), you grant us a perpetual, worldwide, royalty-free license to use, modify, and distribute your contributions.

7. Third-Party Services and Content

The Service integrates with or references third-party services including:

• Cursor (by Anysphere Inc.)
• Claude Code (by Anthropic)
• GitHub (for repository access)
• Discord (for community)
• Polar (for payments)

We are not responsible for third-party services. Your use of such services is governed by their respective terms and policies.

8. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy, which complies with GDPR requirements. By using the Service, you consent to data processing as described in the Privacy Policy.

9. Disclaimers and Limitations of Liability

9.1 "As Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 No Professional Advice

Content is for educational purposes only and does not constitute professional advice. Always use your own judgment and consult professionals when needed.

9.3 Results and Testimonials Disclaimer

Any results, examples, case studies, testimonials, or performance figures presented on our website, marketing materials, or within the Service may not be real and could be illustrative examples based on typical results we have observed in our practice. Individual results may vary significantly based on numerous factors including but not limited to your skill level, experience, dedication, and the specific tools and technologies you use. We make no guarantee that you will achieve similar results.

9.4 Limitation of Liability

To the maximum extent permitted by Polish law, Wondel.ai sp. z o.o. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses.

9.5 Maximum Liability

Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Wondel.ai sp. z o.o., its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

11.1 Termination by You

• Access from a purchase ends at the end of the access period (4.3). There is nothing to cancel, because nothing renews
• Subscriptions bought before the switch are cancelled as described in 4.7
• No refunds for unused time, except as required by law and as set out in 4.5

11.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, for:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment of fees
• Actions harmful to other users or the Service

11.3 Effect of Termination

• Access to Content ceases immediately
• We may delete your account data after 30 days
• Provisions that should survive termination will remain in effect

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email or Service announcement at least 30 days before taking effect. Continued use after changes constitutes acceptance of new Terms.

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law principles.

13.2 Dispute Resolution

1. Negotiation: Parties shall first attempt to resolve disputes through good faith negotiation
2. Mediation: If negotiation fails, disputes shall be submitted to mediation in Warsaw, Poland
3. Jurisdiction: If mediation fails, disputes shall be resolved in the courts of Warsaw, Poland

13.3 Consumer Rights

If you are a consumer residing in the EU, you retain all rights granted under mandatory consumer protection laws, which cannot be waived by these Terms.

14. Additional Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Wondel.ai sp. z o.o. regarding the Service.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions shall continue in effect.

14.3 Waiver

Failure to enforce any right or provision shall not constitute a waiver of such right or provision.

14.4 Assignment

You may not assign these Terms without our prior written consent. We may assign our rights and obligations without restriction.
